1. Agreement to Terms

By accessing or using NEXUS Host's game server hosting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

NEXUS Host provides:

  • Game server hosting for various titles
  • Virtual Private Server (VPS) hosting
  • Dedicated server solutions
  • DDoS protection and security services
  • 24/7 technical support
  • Control panel access for server management

3. Account Terms

When creating an account, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use Policy

You agree NOT to use our services to:

  • Violate any laws or regulations
  • Distribute malware, viruses, or harmful code
  • Engage in DDoS attacks or network abuse
  • Host illegal content or facilitate illegal activities
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to systems
  • Resell services without authorization

5. Payment and Billing

Pricing and Payment

  • All prices are in USD unless otherwise stated
  • Payment is due upon invoice generation
  • We accept major credit cards and PayPal
  • Recurring subscriptions auto-renew unless cancelled

Refund Policy

We offer a 7-day money-back guarantee for new customers on their first order. Refunds are not available for:

  • Dedicated servers or custom configurations
  • Services terminated for Terms of Service violations
  • Partial month refunds

6. Service Level Agreement

We guarantee 99.9% uptime for all services. In the event of downtime:

  • Less than 99.9% but above 99.0%: 5% credit
  • Less than 99.0% but above 98.0%: 10% credit
  • Less than 98.0%: 25% credit

Credits are applied to future invoices and do not apply to downtime caused by:

  • Scheduled maintenance (with 24-hour notice)
  • Customer actions or misconfigurations
  • DDoS attacks exceeding protection limits
  • Force majeure events

7. Data and Backups

You are responsible for maintaining backups of your data. While we implement data protection measures, we recommend regular backups. We are not liable for data loss except in cases of gross negligence.

8. Termination

We may terminate or suspend services:

  • For violations of these Terms of Service
  • For non-payment after 7 days
  • If required by law
  • To protect our infrastructure or other customers

You may cancel services at any time through your control panel.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXUS HOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold NEXUS Host harmless from any claims, losses, or damages arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through our services. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
